Donation Terms & Conditions

1. Scope

These Donation Terms apply to all donations made through a public donation page hosted on the Cirko platform. By making a donation, you agree to these terms. These terms are separate from and do not replace the Cirko Terms of Service, which govern the relationship between Cirko and its subscribing organizations ("Tenants").

2. Who You Are Donating To

Your donation is made directly to the organization (the "Recipient Organization") whose name and details are displayed on the donation page. Cirko is a technology provider that supplies the platform used by organizations to collect donations. Cirko does not receive, hold, or manage your donation funds in any way.

The Recipient Organization is solely responsible for:

  • The use of donated funds in accordance with its stated mission
  • Compliance with applicable charitable and tax regulations
  • Issuing tax receipts (where applicable)
  • Responding to donor inquiries about the use of funds

3. Payment Processing

Donations are processed through Stripe, a third-party payment processor. Payments are made directly to the Recipient Organization's Stripe account. Cirko does not process, store, or have access to your full payment card details.

Supported payment methods depend on the Recipient Organization's Stripe configuration and may include credit/debit cards and SEPA direct debit.

4. One-Time and Recurring Donations

4.1. One-time donations

A single payment is charged immediately. No further charges will be made.

4.2. Installment donations (split payments)

If you choose to split your donation into installments (e.g., 3, 6, or 12 monthly payments):

  • The first installment is charged immediately
  • Subsequent installments are charged automatically on the same day each month via a Stripe subscription
  • The subscription automatically ends after all installments have been paid
  • You will receive a confirmation email for each payment

4.3. Cancellation of installment donations

You may cancel remaining installments at any time by contacting the Recipient Organization directly. Amounts already charged are not refundable unless the Recipient Organization agrees otherwise. Cirko cannot cancel or modify your subscription on behalf of the organization.

5. Refund Policy

Donations are generally non-refundable. If you believe a charge was made in error, or if there are exceptional circumstances, please contact the Recipient Organization directly. The Recipient Organization is solely responsible for deciding whether to issue a refund.

Cirko has no authority to issue refunds, as it does not receive or hold donation funds.

6. Tax Receipts

Where applicable (e.g., CERFA in France under article 200 of the CGI), the Recipient Organization may issue tax receipts for your donations. Tax receipts are:

  • Issued under the sole responsibility of the Recipient Organization
  • Generated for each payment (including each installment of a split donation)
  • Sent to the email address you provide during the donation
  • Retrievable at any time via the Recipient Organization's receipt retrieval page (no account required)

Cirko generates the tax receipt documents on behalf of the Recipient Organization using the legal information provided by the organization. Cirko does not verify the tax-exempt status of any organization and makes no representation about the tax deductibility of your donation. Please consult a tax professional for advice specific to your situation.

7. Your Personal Data

When you make a donation, the following personal data is collected:

  • Identity: First name, last name (or company name and SIREN for corporate donors)
  • Contact: Email address, optionally phone number
  • Address: Full postal address (required for tax receipts)
  • Payment: Payment method details are processed by Stripe and are not stored by Cirko or the Recipient Organization
  • Technical: IP address and security token (Cloudflare Turnstile) for fraud prevention

7.1. Who processes your data

  • The Recipient Organization is the data controller — they decide why and how your data is used
  • Cirko is the data processor — it processes your data on behalf of the organization through the platform
  • Stripe processes your payment data under its own terms of service

7.2. Purpose of processing

  • Processing your donation payment
  • Generating and sending tax receipts
  • Sending payment confirmations by email
  • Fraud prevention and security
  • Marketing communications (only with your explicit consent)

7.3. Retention

  • Donation records and tax receipts: 10 years (legal obligation for fiscal documents)
  • Contact information: duration of the donor relationship plus 3 years
  • Payment data: managed by Stripe under its data retention policy

7.4. Your rights

Under applicable data protection laws (GDPR, CCPA, Israeli Privacy Law, PIPEDA), you have the right to access, rectify, delete, or restrict the processing of your data. To exercise your rights, contact the Recipient Organization directly. You may also contact Cirko at legal@cirko.app for platform-level data inquiries.

8. Consent

By completing the donation form, you consent to:

  • The processing of your personal data as described above
  • Receiving transactional emails (payment confirmations, tax receipts)
  • The applicable terms of service of Stripe for payment processing

Marketing communications require separate, explicit consent via a dedicated checkbox on the donation form.

9. Cirko's Role and Limitation of Liability

Cirko is a technology provider. It supplies the platform that enables organizations to create donation pages and process donations. Cirko:

  • Does not receive, hold, or manage any donation funds
  • Does not verify the legitimacy, tax-exempt status, or activities of organizations
  • Does not guarantee the use of donated funds by the organization
  • Is not a party to the donation transaction between you and the organization

To the maximum extent permitted by applicable law, Cirko shall not be liable for any loss, damage, or claim arising from:

  • The misuse of funds by the Recipient Organization
  • Inaccurate tax receipts issued by the organization
  • Payment processing errors handled by Stripe
  • The tax deductibility or non-deductibility of your donation

10. Modifications

Cirko may update these Donation Terms at any time. The updated version will be published on this page with a new "Last updated" date. Continued use of the donation service after changes constitutes acceptance of the updated terms.

11. Governing Law
